CLARIFICATION OF EVENTS – 09 FEBRUARY 2026 CONSULTATION MEETING AT MALUTI-A-PHOFUNG WATER

The South African Municipal Workers’ Union (SAMWU), Local Leadership at Maluti-a-Phofung Water SOC Ltd, hereby issues this statement to place on record the events that transpired on 09 February 2026 during the consultation meeting convened by the employer.

On 03 February 2026, the employer issued an internal memorandum inviting employees to attend a consultation meeting regarding the proposed disestablishment of Maluti-a-Phofung Water SOC Ltd and the transfer of employees into the Municipality.

On 09 February 2026, employees attended the scheduled meeting in good faith. During the engagement, employees raised concerns that proper and legally recognised channels of engagement had not been followed prior to convening the meeting. Employees referenced established labour platforms, including the Workplace Forum (WPF), as appropriate structures through which such matters should first be processed as informed by S84-86 of the LRA.
Employees further expressed concern regarding procedural compliance in relation to the contemplated transfer process.

As discussions progressed, it was agreed that the meeting be adjourned to allow for the correct channels of engagement to be followed.

Following the adjournment, parties began to vacate the premises. The Municipal Manager, Mr. Mzwakhe Mofokeng, and the Executive Mayor, Cllr. Malekula Melato, exited the premises.

Subsequently, a commotion arose at the entrance of the premises. Members reported that one of the Municipal Manager’s security personnel allegedly made statements that were perceived as threatening toward employees.
SAMWU local leadership immediately intervened to de-escalate the situation. Leadership called upon members to remain disciplined and to avoid any form of confrontation. The security personnel was addressed, and a request was made for municipal personnel to vacate the premises in order to restore calm.

The situation was successfully stabilised without physical confrontation. Members thereafter returned to their respective workplaces.

SAMWU Local Leadership wishes to place on record that the union firmly rejects any form of violence, intimidation, or unlawful conduct. Our position remains rooted in unity, fairness, and lawful engagement. We remain committed to resolving all matters through peaceful, structured, and legally compliant processes.
