SAMWU Statement on the Labour Appeal Court Outcome
The South African Municipal Workers’ Union (SAMWU) notes the outcome of the Labour Appeal Court which sat on the 27th February in Braamfontein.
After hearing arguments from both side and considering the Appellants’ attorneys’ failure to file heads of arguments on time, the Judge made an interim ruling that SAMWU will be afforded an opportunity to respond to their arguments within 7 days, should the union wish to respond. We are therefore in consultation with our attorneys to determine if the Appellants’ arguments warrant a respond from our side.
The judge also made another interim ruling that both parties should attempt to resolve the matter within 7 days through consultations, after which the Judge will make a final ruling on the mater. It is therefore important to note that there has been no judgment or ruling which has been made with regards to the leadership of the union.
We therefore urge our members to be patient and allow this legal process to conclude. We further caution members to be weary of fake news circulating that a ruling has been made on leadership. We are a law abiding organization which is why we have subjected ourselves to this process.
We will be keeping our members updated on the developments in this case and any decisions which may be made in between.
